This is an application filed by the applicant/wife, for transfer of Marriage Petition No. 1087 of 2019, filed by the respondent / husband from the file of learned Civil Judge, Sr. Division, Pune to the Family Court at Bandra, Mumbai.

It appears that this Court had appointed a mediator to the resolve the dispute between the parties and fortunately the mediator has been successful in bringing the parties together, and accordingly the parties have executed consent terms. The mediator has filed his report alongwith consent terms, which are taken on record and marked "X" for identification.

I have heard the learned counsel for the parties. The parties are also personally present in the virtual hearing and they admit 1 / 2

As per clause (Q) of the consent terms, the same are required to be produced and recorded before the learned Civil Judge, Sr. Division, Pune in Marriage Petition No. 1087 of 2019. 5.

In that view of the matter, the learned counsel for the applicant submits that nothing survives in the present transfer application.

In such circumstances, the civil application is disposed of with no order as to costs. It will be open for the parties to produce the said consent terms before the Civil Judge, Sr. Division, Pune in Marriage Petition No. 1087 of 2019. The learned Civil Judge, Sr. Division, Pune shall pass appropriate orders in the matter in accordance with law and in view of the the consent terms. 7.

This Court places on record its appreciation for the efforts taken by the learned mediator in bringing about the settlement between the parties.
