In Crime No. 191 of 2018 for an offence punishable under Section 395 of Indian penal Code both the Applicants are seeking regular bail. Both the Applicants were arrested on 8th June 2018. 2.
The case of the prosecution is, the Applicant has robbed the complainant for an amount of Rs.2,00,000/- after inviting on false pretext of providing gold at concessional rate.

The learned Counsel for Applicants submits that the chargesheet in the matter is filed against the Applicants after their arrest and their further detention is not justified.

The learned APP opposed the claim on the ground that other co-accused are absconding.

Considered the submissions.

After the custodial interrogation hardly anything is recovered from the Applicants. So far as the Applicant No.1 is concerned, she is the wife of Applicant No.2. There are no criminal antecedents against her. Whereas against the Applicant No.2, there are criminal antecedents qua the proceedings under the Bombay Prohibition Act. 7.
Considering the aforesaid submissions, in my opinion, a case for grant of bail is made out. Hence, the following order.
ORDER
(A) Both the Applicants be released on bail in Crime No. 191 of 2018 for an offence punishable under Section 395 of Indian penal Code on executing PR Bond of Rs. 25,000/- each with one or more sureties in the like amount.
(B) Both the Applicants shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.
3/3 Yadav 916.ba.2943.18 (C) Both the Applicants shall attend the Police Station till conclusion of trial in the first week of every Calender month. (D) In case if it is found that the Applicants are involved in similar type of offence, liberty to the prosecution to move for cancellation of bail.
