DATE: 05 MARCH 2015 P.C. :- 1] The judgment and order made in writ petition no. 1143 of 2015 will govern the present case. For the reasons set out in the said judgment and order dated 5 March 2015, no relief, other than what is set out hereafter can be granted to the petitioner. 2] The learned counsel for the petitioner states that the petitioner has been held eligible for a residential tenement. However, he submits that the petitioner claims eligibility for a residential cum commercial structure. It is pointed out that proceeings in this regard are pending before the respondent no. 1 since 14 October 2014. In this regard, the learned counsel for the 1/2

skc 913-wp-1145-15 petitioner points out to Exhibit 'O' (page 111) to the memo of this petition. The learned counsel submits that the respondent no. 1 ought to be directed to consider and dispose of the said proceedings in accordance with law and with utmost expedition. This is because depending upon such determination, the petitioner shall be entitled to receive permanent accommodation having greater area.

3] The request made by the learned counsel for the petitioner is reasonable. Accordingly, the respondent no. 1 is directed to dispose of the aforesaid proceedings within a period of eight weeks from the date the petitioner produces an authenticated copy of this order before the respondent no. 1.

4] Save and except the relief in aforesaid terms, this writ petition is dismissed. There shall be no order as to costs. (M. S. SONAK, J.) Chandka 2/2
