1] Heard the learned counsel for the applicant and the learned APP for the State. Perused the record of investigation. 2] By an order dated 2nd November 2018, the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates, to join the process of investigation. 3] The record of investigation indicates that, in pursuance of the directions issued by this Court, by its order dated 2nd November 2018, the applicant has attended the Investigating Officer and has co­ operated in the process of investigation.

osk 20­aba­2294­2018.odt 4] The learned counsel for the applicant submits that, in pursuance of order dated 2nd May 2018, the applicant has deposited the said sum of Rs.2,30,000/­ in the Registry of the trial Court on 10th December 2018. A photocopy of the receipt issued by Nazir attached to the Additional District Court, Vasai, District Thane, is produced on record.

5] After perusing the record, this Court is of the view that the custodial interrogation of the applicant for further investigation of the present crime is not necessary.

6] In view of the above, interim relief granted by order dated 2nd November 2018 is hereby confirmed. However, the condition to attend the Investigating Officer of the concerned Police Station is waived.
