Heard the learned counsel for the parties.

This application is preferred by wife under section 24 of the Code of Civil Procedure, 1908 for transfer of Hindu Marriage Petition No.79 of 2011 filed by respondent husband before the Civil Judge, Senior Division Panvel to the Family Court at Kolhapur.

The learned counsel for the respondent husband submits that during the pendency of the present Misc. Civil Application, matter is settled between the parties by agreement dated 14.9.2015. He further submits that JMFC, Court No.1, Kolhapur passed order below Exhibit 1 dated 1.7.2015 in Criminal M.A. No.434 of 2011. To that effect, agreement for settlement as well as the 1/3

order passed by JMFC Court No.1, Kolhapur dated 1.7.2015 tendered by advocate for respondent husband taken on record and marked 'X' and 'X1' for identification. He submits that in view of subsequent development nothing survives in the present Misc. Civil Application.

Considering the submissions made by the learned counsel for the respondent husband, settlement deed / agreement dated 14.9.2015 and order dated 1.7.2015 passed by JMFC, Court No.1, below Exhibit 1 in Criminal M.A.No.434 of 2011, I am satisfied that nothing survives in the present application.

Misc. Civil Application stands rejected.
