Heard the learned Counsel for the parties.

This is an application for transit pre-arrest bail. The Applicant apprehends arrest in C.R.No.510 of 2023 registered with Wazirganj Police Station for the offences punishable under Sections 406 and 323 of the Indian Penal Code. 3.

I have perused the allegations in the FIR. Prima facie, does not appear that the applicant has made an inducement or there is any entrustment of the property to the applicant. Prima facie, the applicant is alleged to be the mastermind of the coaccused, who allegedly duped the brother of the first informant. 4.

Having regard to the nature of the accusation, the punishment the offence punishable under Section 406 entails and the fact that the applicant desires to approach the jurisdictional court, I am inclined to grant transit pre-arrest bail. SSP 1/2

The applicant shall appear before the SHO, Wazirganj Police Station on 8 November 2023.

In the meanwhile, in the event of the arrest of the applicant - Mohammed Salman Kapadia in connection with C.R.No.510 of 2023 registered with Wazirganj Police Station, the Applicant be released on bail on furnishing a PR bond in the sum of Rs.30,000/- with one or two sureties in the like amount. 6.

This order shall remain in operation till 20th November 2023. 7.

The application stands disposed.
