The Petitioner, a Mukadam representing Toli No.521, has made a grievance that this Toli was allotted work with Sejal Shakti Realtors LLP by order dated 2 February 2019. However by impugned order dated 16 May 2019 passed by the Respondent No.1Mumbai Iron and Steel Labour Board Mumbai, Respondent No.2 Toli No.568 has also been allotted work with the same employer.

The principal grievance of the Petitioner is that this order dated 16 May 2019 has been passed without hearing the Petitioner. Learned Counsel for the Respondent No.1- Board accepts that this order dated 16 May 2019 is passed without giving hearing to the Petitioner. He states that now to pass an order, hearing will have to be given both to the Petitioner as well as Toli No.568. He states, on instructions, that hearing will be given both to the Petitioner as well as Respondent No.2 and an order will be passed within period of four weeks. We accept the said statement keeping contentions of Petitioner and Respondent No.2 open.

Parties will maintain status-quo as of today till the order is passed and the order dated 16 May 2019 will be treated as prima facie opinion of Respondent No.1.

Writ Petition is disposed of in above terms.
