By this Petition under Article 227 of the Constitution of India, original plaintiff has challenged the judgment and order dated 24.10.2013 passed by the learned Judge, City Civil Court (Borivali Division), Dindoshi below exhibit-34 in L.C.Suit No.2823 of 2005. By that order, the learned trial Judge rejected the application filed by the plaintiff for issuing witness summons to the Estate Manager of R/South Ward for producing the documents.

Mr. Mahadik submits that the main Suit itself is disposed of, and therefore, the Petition has become infructuous. He seeks permission to withdraw the Petition.
