This is an application for relaxation of condition of attending Police Station Kurla on first Monday of every month imposed on the applicant while directing his release on bail vide order dated 11/08/2005 in Criminal Application No.4838 of 2005. Heard the learned Advocate appearing for the applicant/accused as well as the learned Additional Public Prosecutor.

(23)APPANo.15302015 The applicant/accused was convicted of offences punishable under Sections 325 read with Section 34 of Indian Penal Code vide impugned Judgment and Order dated 30/06/2005 by the learned trial Court. While releasing on him on bail vide order dated 11/08/2005, the condition as noted in opening paragraph of this order was imposed on the applicant/accused. It is undisputed that the applicant/accused had complied with that condition up till now. Considering the nature of offence held to be proved against the applicant as well as the fact that from the year 2005, the applicant is following the condition of attendance at the Kurla Police Station, the application deserves to be allowed and, therefore, the order :
(i) The condition of attending the Kurla Police Station on first Monday of every month imposed on the applicant/accused vide order dated 11/08/2005 in Criminal Application No.4838 of 2005 is deleted. (A.M.BADAR J.) Gaikwad RD 2/2
