The applicant i.e., the original accused No.1, has been convicted mainly under section 302 r/w section 34 of the Indian Penal Code. Being aggrieved thereby, he has preferred Criminal Appeal No.128 of 2012. This application is preferred in the said appeal and the applicant has prayed for bail in the present application. However, it is seen that the applicant has also preferred Criminal Application No.1234 of 2015 in the very same Appeal wherein the prayer is for bail on the same grounds as the grounds in this application. Criminal Application No.1234 of 2015 was disposed of today. In this view of the matter, this application is disposed of as infructuous.
