Petitioner No. 1 is present with his advocate. Similarly respondent No. 1 is present in person.
Our attention is invited to the fact that in Marriage Petition No. 596 of 2014 filed in the Court of Civil Judge Senior Division, Thane by Petitioner No. 1 against the respondent, settlement pursis was filed on 7/2/2019 and necessary agreed amount was also deposited.
Respondent No. 1 present in court is identified by petitioner no. 1 as also by his advocate independently. Talwalkar
25.apl1304.14.doc Respondent No. 1 informs that proceedings in Thane Court are still pending. After the present proceedings are disposed of, that matter will continue and marriage would be dissolved. She further states that thereafter, she can withdraw the amount, which is deposited in Thane Court. She is represented by an advocate in that court. That matter is now scheduled on 12/12/2019.
In these situation, she has given no objection for quashing of criminal case against the petitioner. As consent terms are already filed in the court at Thane, in view of joint request made, we make rule absolute in terms of prayer clause (a).
