Learned counsel for the applicant, upon instructions from the applicant seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. Learned counsel for the applicant submits that the applicant would surrender before the Magistrate on 12th February 2018. The learned Magistrate shall consider the application on the same day as per the guidelines laid down by the Hon'ble Apex Court in the case of Arnesh Kumar Vs. State of Bihar, reported in (2014) 8 Supreme Court Cases, page 273. Learned Magistrate shall consider the application on it's own merits without being influenced by the withdrawal of the present application.
