CORAM : R.D. DHANUKA, J.
DATE : 9TH FEBRUARY, 2016.
P.C. :- 1.
By an order dated 12th June, 2015, this Court has allowed Misc. Civil Application No.61 of 2015, thereby transferring Marriage Petition No.A-142 of 2014 pending in the Family Court No.1, Pune to the Family Court at Kolhapur. I have perused the office note dated 3rd July, 2015 which refers to the letter dated 5th December, 2015 from the learned Judge, Family Court, Kolhapur expressing his prima-facie view that the learned Civil Judge, Senior Division, Ichalkaranji will have jurisdiction to try the transferred proceedings in view of the fact that the marriage was not solemnized within the local limits of Kolhapur and the respondent was not residing within the local limits of Family Court, Kolhapur. The learned Civil Judge, Senior Division, 1/2
3-mca61-15 Ichalkaranji seeks guidance whether to direct transfer the proceedings at Family Court, Kolhapur though it comes within the local limits of the learned Civil Judge, Senior Division, Ichalkaranji. 2.
Learned counsel appearing for the applicant submits that he has no objection if the proceedings are transferred to the learned Civil Judge, Senior Division, Ichalkaranji, which according to the learned counsel will have jurisdiction to try these proceedings upon such transfer. The statement is accepted.
3.
The Family Court at Thane is accordingly directed to transmit the papers and proceedings of Marriage Petition No.A-142 of 2014 to the Court of the learned Civil Judge, Senior Division, Ichalkaranji expeditiously. The order dated 3rd July, 2015 passed by this Court accordingly is partly modified to the aforesaid extent. (R.D. DHANUKA, J.) 2/2
