Learned counsel for the Applicant states that the Applicant is in custody since 2015 and that the last three witnesses were examined way back in 2016. He states that after 2016 i. e. for the last three years, there is no progress whatsoever in the case.

Learned APP on instructions of the investigating officer states that only 3-4 witnesses are yet to be examined. He states that the trial be expedited and be made time bound.

Without going into merits of the Application, since the trial has commenced and since there is no progress in the case for the last three years, it would be appropriate to direct the learned Sessions Judge to conclude the case as expeditiously as possible and in any event, within a period of three months from the date of receipt of this order. The prosecution to ensure that all the witnesses are made available on the dates given by the trial Court. 4.

The Application is, accordingly, disposed of with the aforesaid direction.

It is made clear, that this Application has not been heard on merits.

All concerned to act on the authenticated copy of this order.
