Learned APP informs, on instructions from the concerned officer on the police station, that notice is served through WhatsApp Messenger App on Respondent No.2/Informant. In spite of the same none appears.

The Application is filed for condonation of delay caused in filing the Appeal. The delay is of 1437 days. It is stated that the Applicant is in jail. He sent his Application from jail to the office of Legal Services Manoj

2 9-APEAL(ST)-20758-2023. doc Committee seeking Legal Aid. It is thereafter the appointed Advocate asked for documents required for preparing and filing the Appeal. In that process some time was taken. Advocate thereafter filed the Appeal. It is stated that the delay is caused for these reason.

Considering the position this Court finds that case is made out to condone the delay.

Delay is thus condoned.
