Learned APP submitted that the prosecution has examined about 84 witnesses and 35 more witnesses are yet to be examined. The trial is proceeding on day to day basis. Learned counsel for the applicant submits that applicant may be permitted to withdraw this application with liberty to prefer fresh application for bail, in the event the trial is not concluded with short span of time. 2.

Considering the fact that the trial Court is proceeding on day to day basis and so far prosecution has examined 84 witnesses and as submitted by the learned APP, 35 more witnesses are yet to be examined, the application is allowed to be withdrawn with liberty to file fresh application for bail, in the event the trial is not concluded within 4 months from today.
