Rule.

The learned AGP waives service for Respondent Nos.4 and 5.

By consent, the petition is heard finally.

The learned counsel for the Petitioner submits that the proposal submitted by the Management for transfer of the Petitioner annexed at Exhibit - F to the petition has not been decided by the Petitioner till date.

We accordingly, direct Respondent No.2 to decide the said proposal submitted by the Primary Education Officer, Zilla Parishad regarding individual approval to the appointment of the Petitioner to the post of Assistant Basavraj G. Patil 1/2

44.4580.21-wp.odt Teacher in Respondent No.5 School within six weeks from today in accordance with law.

The order that would be passed by Respondent No.2 would be communicated to the Petitioner as well as the Management within a week from the date of passing the order.

If the order that would be passed goes against the Petitioner, Respondents No.5 and 6 would not take any coercive steps against the Petitioner for a period of three weeks from today.

If the order is in favour of the Petitioner, Respondent No.3 shall include the name of the Petitioner in Shalarth Pranali.

The Respondent No.2 shall release the payment to the Petitioner from the date of initial appointment till the grant of individual approval within six weeks from the date of Respondent No.2 granting approval in favour of the Petitioner.

The Writ Petition is allowed in the aforesaid terms. Rule is made absolute in terms of the above.
