Heard the learned counsel Mr.Iyengar for the petitioner and the learned Additional Public Prosecutor Ms.Mhaispurkar, for the respondent - State of Maharashtra.

After having gone through the impugned order, this Court had indicated to the learned counsel that the Court is not inclined to interfere in the order. At this stage, learned counsel for the petitioner prays for expeditious hearing of the case. The applicant is a retired government officer and he is more than 60 years old. He fall under the category of senior citizen. By virtue of being a senior 1/2

wp-5025-14 citizen, he is entitled for expeditious hearing of the case, as per the directions issued by the High Court to all the trial Courts. In view thereof, it is directed that the criminal case no.3222/PW/2005, pending in the Court of Metropolitan Magistrate Borivali 26th Court shall be heard expeditiously and preferably at least three working days in a week and shall be disposed of within a period of three months from today.

The petition stands disposed of accordingly.
