The petitioner seeks writ of certiorari challenging rule 38(2) (f) and instruction (1) of Maharashtra Civil Services (General Conditions of Services) Rules, 1981. The petitioner also prayed for correction of his date of birth from 4th June 1955 to 4th June 1960. Admittedly, the petitioner stood retired from service on 30th June 2013. Petitioner's application for correction of date of birth cannot be entertained now as the petitioner has already retired. His challenge to the validity of rule has become academic. Therefore, we are not inclined to entertain this petition in exercise of extra ordinary writ jurisdiction. Petition is dismissed.
