1) By a detailed order dated 15.12.2015 this Court has granted interim relief in favour of the applicants. The learned APP, on instructions, submitted that the applicants have attended the Investigating Officer on the stipulated dates. She further, on instructions, submits that the custodial interrogation of the applicants is not necessary. It is to be noted here that, as observed earlier, the complainant has not offered any explanation about the fact that what prompted him to keep the huge amount collected from the students in his personal cup-board / locker, without depositing the same with the higher authority of the institute or with the Principal of said college. Even in the investigation carried till date the said aspect has

2 /2 9-ABA-1873-2015.doc not been explained by the original complainant. 2) In view of the above, the interim relief granted by an order dated 15.12.2015 is confirmed.

3) The applicants shall attend the Investigating Officer as and when called for between 10:00 a.m. to 1:00 p.m. It is needless to mention that before calling the applicants to the police station, the concerned police officer shall issue a notice under section 160 of Cr.P.C;
