In fact the present matter was heard at length and was posted for orders in order to enable the learned counsel to take instructions as to whether he would invite the orders or withdraw the application.

Today, the learned counsel for the applicant submits that during the pendency of this application, one of the co-accused has been granted bail by the Sessions Court and therefore the present applicant desires to take a chance before the Sessions Court seeking parity with the accused, who has been enlarged on bail. However, liberty as prayed for is granted in the interest of justice. The learned Sessions Court shall decide the present application on it's own merits.
