Heard the learned Counsel for the applicant.
This is an application under section 438 of the Code of Criminal Procedure, 1973. The applicant herein is apprehending his arrest in Crime No. 415 of 2016 registered at Kandivali Police Station for offence punishable under section 498A, 406, 323, 504, 506 r/w. 34 of the Indian Penal Code.

The applicant happens to be the mother-in-law of the complainant. By an order dated 15/12/2016, the applicant was granted interim relief after considering the merits of the matter. Hence, in view of the guidelines in Arnesh Kumar v/s. State of Bihar, interim relief granted vide order dated 15/12/2016 deserves to be confirmed.
Hence, following order is passed :
(I) The application is allowed on same terms and conditions, which are as follows :
(i) In the event of arrest in Crime No. 415 of 2016 registered at Kandivali Police Station, the applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
(ii) The applicant shall attend concerned police station as and when called.

(iii) The applicant shall not tamper with the evidence and/or influence the witnesses in any manner whatsoever. The application is disposed of accordingly.
