The learned APP, at the outset, submits that in the present case, two witnesses are examined. In the midst of the trial, it would not be appropriate to consider the application under Section 439 of Cr.P.C. 2.

In these circumstances, the learned Senior Counsel for the applicant, upon instructions, seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. Application stands dismissed as withdrawn.
