Heard learned counsel appearing for the Applicant. Perused the averments made in the Application. There was a delay in filing affidavit of service in terms of the order dated 5th October 2015 passed in Civil Application No.2206 of 2015. In view of the explanation for delay, the Writ Petition deserves to be restored by setting aside the conditional order which is a part of the order dated 5th October 2015. Accordingly, we dispose of the Application by passing the following order:

ash caw-47.16 ORDER :

(a) The Writ Petition is restored which shall be fixed for admission on 22nd February 2015. To be placed in the category of "Fresh Matters";

(b) Advocate for the Applicant to give private notice to all the concerned Respondents informing them about the date fixed;

(c) If any ad-interim order was operative till 5th October 2015, the same shall continue to operate till the next date.
