The applicant was granted bail by the Additional Sessions Judge, Raigad by order passed below Exhibit-10 in Special (MPID) Case No.9 of 2018 on the basis of undertaking of the applicant that he would deposit Rs.40 lakh before release on bail and Rs.10 lakh after he is actually released on bail. It is submitted that the applicant could not avail of the bail facility as he did not pay the amount as undertaken. The applicant is in custody since five months. In the circumstances, it would be appropriate that the applicant prefers such application for modification before same Court which had granted him bail. It is made clear that the Trial Court shall decide such application, if made, on merits and in accordance with law. Criminal Application No.417 of 2019 is disposed of. (PRAKASH D. NAIK, J.) MST
