DATE: JANUARY 24, 2020 P.C.:- 1] The order impugned is dated 15/6/2019 passed by the learned District Judge in Civil Misc. Application No.105 of 2018 preferred by the Petitioner for restoration of Civil Appeal No.38 of 2014 which was dismissed by the learned District Judge by order dated 23/1/2018. 2] Restoration of the said appeal is ordered, subject to deposit of arrears of Rs 2 lakh within one month.

3] After hearing learned Counsel for the Petitioner for some time on merit, I hardly notice any ground which warrants indulgence. Petition stands dismissed. However, prayer of the Petitioner for 1/2

(12) wp-200-20.doc permission to deposit amount of Rs 2 lakhs in installment is accepted. 4] Petitioner is granted liberty to deposit amount of Rs 1 lakh by 16/3/2020, whereas balance amount of Rs 1 lakh be deposited by 30/4/2020.
