34-APPA-1539-2016.doc The applicant / accused is challenging his conviction and sentence imposed upon him as per relevant sections of the Foreigners Act, 1946, and Passport Entry into India Act, 1950, read with relevant Rules. His appeal is already admitted for final hearing. As such, presence of the applicant / accused is not required at the time of final hearing of the appeal. He is duly represented by his learned counsel.

The application is, therefore, rejected.
