P.C.:- This is a consecutive Application for bail.

The earlier Bail Application No.1131 of 2018 was rejected by this Court by its reasoned Order dated 28th June, 2018. It is observed in the earlier Order that, there is sufficient material available on record to show complicity of the Applicant in the present crime. That, offence alleged against the Applicant is of robbery with murder on a highway and taking into consideration the gravity of the offence, this Court had rejected the Application preferred by the Applicant on earlier occasion. Mr. Mishra, learned counsel for the Applicant submitted that, the Applicant is in jail for more than two and half years and till this date, the prosecution has not framed charge in the matter. 1/2

ssm 2 6-ba3386.19.doc Except the aforestated submission, no change in the circumstance is pointed out by the Applicant for reconsideration of his Bail Application.

As noted earlier, after taking into consideration the gravity of the offence and the aforestated observations, the Bail Application of the Applicant was rejected by this Court by its Order dated 28th June, 2018. In view thereof, I find no merits in the Application, Application is accordingly rejected.

As the Applicant is in Jail since 5th August, 2017, the learned Additional Sessions Judge, Kalyan seized of Sessions Case No. 351 of 2017 arising out of C.R.No. I-99/2017, registered with Murbad Police Station is hereby requested to expedite the hearing of the said case. Bail Application is accordingly dismissed in the aforesaid terms.
