Mr. Mohite, the learned counsel for the applicant seeks leave to withdraw the application and submits that he would surrender before the investigating officer on 27th January, 2016. 2.

Mrs. Mulekar, the learned APP for the State upon instructions from the T.V. Bhise, PSI, Daund Police Station, investigating officer, made statement that till 11 am of 27th January, 2016, the applicant shall not be arrested. He has further submitted that the presence of the applicant is not required for custodial interrogation. Statement is accepted.
