IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 4892 OF 2015 Dnyandeo Vithal Ukarde.
..Petitioner.
Versus
State of Maharashtra & Others.
..Respondents.
Mr. S. R. Dubey for the Petitioner.
Mr. J. P. Yagnik, learned APP for the State.
Coram : RANJIT MORE & V. L. ACHLIYA, JJ.
Date : January 4, 2016.
P. C. :
1.
By this writ petition, a direction is sought to learned Metropolitan Magistrate, Mulund to conduct the trial expeditiously and dispose of the case pending on its file, being CC No. 12/PW/2014. The ground pressed into service is that the Petitioner is senior citizen.
2.
Learned Counsel appearing for the Petitioner does not dispute that the Petitioner has directly approached this Court without making such a request to the concerned Court. Be that as it may, the case is of the year 2014. Undisputedly, the pendency in the trial Court is a matter of concern for all. Being aware of the huge pendency in the Courts below, it would not be just and proper for this Court to issue direction for the disposal of a specific case without there being any extra-ordinary reason. We have full sympathy with the Petitioner. But for the reasons patilsr 1 / 2
stated above, we are unable to issue direction. Let the Petitioner make a similar request to the learned Metropolitan Magistrate, who is seized of he matter. No relief can be granted in this writ petition and hence writ petition is dismissed. [V. L. ACHLIYA, J.] [RANJIT MORE, J.] patilsr 2 / 2
