By this application, the Applicant-wife is seeking transfer of Marriage Petition No. 68 of 2017 filed by the Respondent-husband before Family court at Nasik to the Family Court at Bandra, Mumbai, where the Petition filed by the Applicant bearing No. 4393 of 2017 for maintenance, under section 125 of the Cr.P.C., is pending. The Applicant is a lady, having responsibility of the custody of a female child of one year and ten months and considering the difficulty faced by her in traveling on every date to Nashik, to attend Borey 1/2

spb/ 904-mcast33450-17.odt the hearing before the Family Court, Nashik, and the apprehension expressed by her of physical assault at the hands of the Respondenthusband because she has filed a complaint against the Respondent under section 498-A of the Indian Penal Code, this application is allowed.

Marriage Petition No. 68 of 2017 filed by the Respondent before the Family Court at Nashik is transferred to Family Court at Bandra, Mumbai.
