Learned Counsel for the applicant, on instructions, seeks leave to withdraw this application, with liberty to file a fresh application. He submits that as the applicant has not complied with the undertaking, the interim relief was vacated.

Learned Counsel for the applicant submits that the applicant be granted liberty to file a fresh application, in view of the change of circumstance, inasmuch as, the applicant is now ready to deposit the amount, pursuant to the undertaking given by him, in the aforesaid SQ Pathan 1/2

Accordingly, the application is disposed of as withdrawn with liberty as prayed.
