This is an application under Section 438 of the Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R. No.55 of 2022, registered with Andheri Railway Police Station for offences punishable under Sections 354A, 384, 419, 420, 465, 468, 471, 473 and 509 r/w 34 of the IPC and Section 67 A of the Information Technology Act, 2008.

By order dated 09/12/2022 this Court (Coram: M.S. Karnik, J.) had granted interim bail to the Applicant with direction to report to the Investigating Officer.

Learned counsel for the Applicant states that pursuant to the said order the Applicant has reported to the Investigating Officer and that he has been interrogated.

Learned APP, under instructions from the Investigating Officer, who is present before the Court states that presence of the Applicant is not required for the purpose of custodial interrogation. In the light of the said statement, application is allowed on the following terms and conditions:- (i) In the event of arrest of the Applicant in C.R. No.55 of 2022, which is registered with Andheri Railway Police Station, the Applicant shall be released on bail on furnishing PR bonds in the sum of Rs.25,000/- with one or two sureties to the like amount.

(ii) The Applicant shall report to the Investigating Officer as and when required by the Investigating Officer.

(iii) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and /or change of residence or mobile details, if any, from time to time.

The application stands disposed of.
