The learned counsel for the appellant has placed on record a communication dated 9th March, 2020 addressed to him by the Assistant Engineer, Zone II, K/East Ward. The said communication is taken on record and marked as 'X' for identification.

The said communication record that the structure of the appellant being Structure No.313 is standing and is being affected by the widening of Jogeshwari Vikhroli Link Road and even a compensation is being offered. By the notice issued, he has been asked to remove the structure with the specifications mentioned in the said notice.

In light of the said communication received, the appellant is not desirous of prosecuting the appeal and seek leave of this Court to withdraw the same.
