The Petition filed by the Petitioner-Bank seeks directions to the Collector to take steps under section 14 of the Securitization & Reconstruction of Financial Assets & Enforcement of Security Interest Act, 2002 (SARFAESI Act) and to hand over possession of the sugar factory to the Petitioner.

By an amendment, the notice dated 11-12-2017 which sought to auction the secured asset was also challenged. 3.

Inasmuch as during the pendency of the Petition the Collector has now passed an order dated 15-01-2018, nothing survives for consideration in this Petition.

Hence, the Petition to stand disposed of.

If the Petitioner-Bank has any grievance as regards the order dated 15 January 2018 of the Collector, it may take recourse to appropriate remedy as available in law.
