By this civil application, the Applicant is seeking to recall the order dated 18th August, 2017, by which the writ petition No. 2270 of 2016 stands dismissed for non-prosecution.

Learned counsel Mr. Abhijeet Kandharkar for the Applicant submits that pending the hearing and final disposal of the present civil application, the Family Court No.5, Pune Tikam 1/

17- CAW 3024 of 2017.doc decided P.A. No. 459 of 2010 on its own merits. He submits that he has preferred Family Court Appeal against that order. He submits that in view of the subsequent development, nothing survives in the present proceeding.

In view of the subsequent development, this civil application stands disposed of as infructuous.
