This is an application for modification of order dated 7.5.2015. By the said order the applicant was directed to release on bail on certain conditions. At the out set, the learned counsel appearing for the applicant restricted his prayer with reference to prayer clause(a) of the present application
2 /3 and did not press the other prayer clauses viz. (b)and (c).
2) By an order dated 7.5.2015 this Court while releasing the applicant on bail has imposed a condition that the applicant shall attend the office of EOW, Thane on every Friday and Saturday between 10.00 a.m. to 1.00p.m. till the conclusion of the trial.
The learned counsel appearing for the applicant submitted that the applicant has made various allegations against the Investigating Officer to whom the applicant has been directed to report. He submitted that except the present particular Investigating Officer he may be directed to mark his presence to any other officer.
Mr. Mendadkar, learned counsel appearing for the intervener-complainant submitted that in the present application the applicant has filed incorrect and wrong documents thereby showing that the applicant is not liable to pay anything to the complainant . He submitted that liberty may be granted to him to move an appropriate application before this Court for redressing the grievance of the complainant. It is needless to mention that the original complainant is at liberty to file necessary
3 /3 application if so advised for redressal of her grievances.
3) For the reasons stated in the application and in the interest of justice, I am inclined to allow the present application. 3) Hence, the following order.
ORDER
a) The condition No.(ii) of order dated 7.5.2015 is hereby modified and the applicant is hereby directed to attend the Trial Court on every Monday and Wednesday between 11.00 a.m. to 1.00 p.m. to mark his presence. This condition is in addition to the condition that the applicant shall attend all the Trial Court dates.
b) Rest of the conditions in order dated 7.5.2015 are not disturbed.
c) Application is allowed in the aforesaid terms.
