This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 371 of 2021 registered at New Panvel Police Station, for the offences punishable under Sections 8(C), 22(C), 29 of the Narcotics Drugs and Psychotropic Substances Act, 1985.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The applicant is accused No. 6 in the aforesaid crime. According to the prosecution, on 30 December 2021, the accused No. 1 was apprehended and 1 kg psychotropic substance- Mephedrone was found in his possession. During the course of investigation, accused Nos. 2 to 5 were found to be involved in manufacturing and sale of said psychotropic substance. According to the prosecution, the present applicant had supplied to accused Nos. 1 to 5 raw material/ chemicals for manufacturing the said psychotropic substance. 5.

The applicant is running chemical shop. There is nothing on record to show that the applicant was prohibited from selling the raw material/ chemicals on the basis of which the alleged psychotropic substance was manufactured. In absence of it, I am inclined to release the applicant on bail. Hence, the following order is passed : (i) Application is allowed.

(ii) The applicant - Jagjeetprasad Ramprakash Prajapati be released on bail in Crime No. 371 of 2021 registered at New Panvel Police Station, for the offences punishable under Sections 8(C), 22(C), 29 of the Narcotics Drugs and Psychotropic Substances Act, 1985 on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.

(iii) The applicant shall attend the concerned police station once in a month i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial.
