Heard learned Counsel for the parties. It is stated that the parties have settled the matter. The Consent Terms are taken on record and marked 'X-1' for identifcation. 2.

I have interacted with Shri Manohar N. Kelkar (Petitioner), Respondent No.3 - Shri Ajit Kulkarni (Chief Manager of the Cosmos Co-operative Bank Ltd.), Respondent No.4 - Mrs.Vinaya Kelkar who is representing M/s. A.N. Transport as its authorised partner, Respondent No.5 - Mrs.Vinaya Kelkar in her personal capacity, Respondent No.6 - Mr.Nilesh Laxman Kelkar, added Respondent No.9 - Mr. Amol Joshi who is authorised partner of M/s.Joshi Buildcon Landmarks. The parties are identifed by their respective Advocates. The parties say that they have read the Consent Terms and have duly signed the same. The parties agreed to abide by the Consent Terms. The undertakings mentioned therein are accepted. Demand Draft in terms of the Consent Terms has been handed over by Respondent No. 8 (in WP/12013/2013) & Respondent No. 9 ( in WP/12012/2013 & WP/12014/2013) to the Chief Manager of 2/3

Respondent No.3 - Bank . On behalf of Respondent No.3 it is submitted that demand draft has been received. The Petitions are disposed of in terms of the Consent Terms. In view of the disposal of the Petitions, Civil Applications do not survive and the same stand disposed of.
