By this Application, the Applicant seeks cancellation of the Anticipatory Bail granted to the Respondent Nos. 2 to 6 - Accused vide order dated 18.10.2016.

It is not in dispute, that during the pendency of the aforesaid Application seeking cancellation of the Anticipatory Bail of Respondent Nos. 2 to 6, charge-sheet was filed as against the said Respondents.

Considering the same, nothing survives for
APPLN 716-16.doc consideration in the aforesaid Application, as the same is rendered infructuous. However, it is always open for the Applicant to file an appropriate Application, if there is a breach of any undertaking by the Respondent. If such an Application is filed, it is open for the learned Sessions Judge to consider the same on its own merits , in accordance with law, uninfluenced by the order passed by this Court.

At this stage, learned counsel for the Applicant states that he intends to file an Application before the trial Court on behalf of the Complainant for return of the articles. It is always open for the Applicant to file such an Application seeking return of articles. If such an Application is filed, the learned Judge shall decide the same in accordance with law.
