Heard. Applicant seeks his enlargement on bail, in C.R. No. 195/2019, registered with Gamdevi Police Station for the offences punishable under Section 376 of the Indian Penal Code.

Complainant is 38 years old, divorcee, working at HM Revenue (UK Income Tax London Central)

2/3 BA-3406-2019 (SR.910) as Income-Tax Fraud Investigation Officer in the United Kingdom. Complaint, prima-facie, suggest her consensual relationship with the applicant. The learned Sessions Judge declined to enlarge the applicant on bail, may be on the ground of noncognizable complaint being lodged by the complainant against the applicant. Evidence shows, first non-cognizable complaint dated 29 th March, 2019 is palpably incorrect, in view of the fact that the mobile number ending with digits 9062 belongs to one, Kamal Kurhade, and not of applicant or his family members.

Be that as it may, in view of the facts of the case and the nature of accusation, the applicant arrested, in C.R. No. 195/2019 registered with Gamdevi Police Station, is directed to be released on bail on furnishing P.R. Bond of Rs.25,000/- (Rs. Twenty Five Thousand only) with one or two sureties in the like amount.

4. The applicant shall attend the concerned

3/3 BA-3406-2019 (SR.910) Police Station as and when called.

The applicant shall furnish the particulars of his place of residence and mobile number to the Investigating Officer within seven days from his release on bail.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

Bail Application is allowed and disposed off.
