By an order dated 2nd March, 2023 (Coram:- Amit Borkar, J.), this Court had directed the appellant to deposit an amount of Rs.8,67,921/- within four weeks.

Thereafter, on several dates adjournments were sought by the appellant on various grounds.

On 30th March, 2023, matter was taken on board and

12-140-2023-FA=.doc extension of time was sought to deposit the amount on the ground that it was March ending.

Thereafter, on 28th July, 2023 at the joint request of the parties, the matter came to be adjourned till 11th August, 2023. 5.

Again on 8th September 2023, at the request of learned Counsel for the appellant and by way of last chance, the matter came to be listed today to enable the Counsel to make a statement as to whether the amount is deposited.

Although learned Counsel for the appellant today submits that he is seeking discharge from this case, that itself will not absolve the appellant to comply with the directions issued by this Court earlier.

For the said reasons, the appeal stand dismissed. 8.

In view of the dismissal of the appeal, pending application/s, if any, also stand dismissed.
