Advocate Shri Sunny Punamiya, holding the brief of Shri Dilip Shukla, the learned counsel for the applicant, prays for time.

I find that similar requests were made on 6th January 2016 and 25th January 2016 also. By the order dated 6th January 2016, leave to amend the application, by annexing copy of the avk 1/2

20-ALP-543-2015.doc notes of evidence adduced during the trial, was granted. On 25th January 2016, further time to amend the application was granted, but it was made clear that the time was being granted finally. Till today, the amendment has not been carried out. Shri Sunny Punamiya informs that Shri Dilip Shukla is unable to remain present before the court and makes a statement that Shri Sunny Punamiya himself is also unable to make any submissions; and states that as a matter of fact, he does not have the brief with him.

Under these circumstances, after having gone through the impugned judgment, I am not inclined to grant leave. Leave refused.

The application is rejected.
