ORDER:- The Petitioners have challenged impugned interim order dated 22 September 2015 passed by the Central Administrative Tribunal (CAT) Bombay Bench at Mumbai, in Original Application No. 535 of 2015 filed by the Respondents. Admittedly, the Original Application is pending. Petitioner Nos. 1 and 2- original Respondent No.2, therefore, to appear before the CAT and make their respective submissions, including the issue of jurisdiction, apart from the merits of the matter.

We are not inclined to entertain the present Writ 1/2

ssm 2 14-wp12568.15.sxw Petition, at this stage, against the order, so referred above. By keeping all points open, we are permitting the Petitioners to withdraw the present Writ Petition with liberty to take steps before the CAT.

It is made clear that the inquiry before the Internal Complaint Committee to continue, but there is no question to pass final order, it will be subject to order passed by the CAT.
