In view of the order passed in Criminal Writ Petition No.2911/2016 whereby the Applicant No.1 is granted permission to file his appearance and contest the proceedings before learned J.M.F.C., Pune in Criminal Misc. Application No.469/2014, I am not inclined to entertain this Criminal Application for quashing of the complaint at this stage. No particular order is challenged in this application. Deshmane(PS)

Since the order passed by the learned Magistrate of proceeding exparte is set aside in Criminal Writ Petition No.2911/2016, the Applicant No.1 gets an opportunity to appear before the Magistrate and putforth his case. Therefore, at this stage, I am not inclined to quash the complaint. Hence, this Criminal Application is also disposed of. In case any adverse order is passed against the Petitioner, it can be challenged in accordance with law. Contentions of both the parties are left open.
