Mr. Datar and Mr. Deo, learned counsel for the parties jointly submit that the parties are already before the arbitral tribunal and endeavour is being made to settle the disputes and the settlement almost finalized.

These are the proceedings of the year 2014 which have been filed challenging an order passed by the learned District Judge rejecting the Section 9 Application filed by the appellant. There are no interim 1/2

In view of further development that the parties are before the arbitral tribunal and settlement talks are in progress, keeping all the contentions of the parties open, present Appeal is disposed of. In the event the endeavour of the parties to settle the disputes fails, liberty to the parties to file appropriate proceedings.

In view of disposal of the Appeal, Civil Application would not survive and the same is disposed of .
