Ms. Shinde, learned APP, at the outset, submits that CC No.29/PW/10 pending before Mazgaon Court, Mumbai, is now transferred to 70th Court at Sewri. She also submits that 5 witnesses are already examined and the Investigating Officer is in witness box and his examination-in-chief is also recorded. She submits that the case would be disposed of within a period of three months from the date of receipt of this order.

In the light of the above statement, Mr. Desai, learned counsel for the petitioner, stated that he does not press this petition at this stage.

The petition is, accordingly, disposed of with direction to learned Metropolitan Magistrate, 70th Court, Sewri, to dispose of the CC No.29/PW/10 as expeditiously as possible and preferably within a period of three months from the receipt of this order. Ordered accordingly.
