Today when the matter came up for hearing, learned counsel for Petitioners made a limited prayer that the Petitioners may be permitted to file a representation to Respondent no.3 Commissioner of Sugar in regard to the alleged illegality committed by Respondent no.4 in respect of conversion of deposits of members into equity capital.

In view of the above limited prayer, without commenting on the merits of the petition, we dispose of this petition with liberty to the Petitioners to submit a detailed representation with supporting documents to Respondent no.3 Commissioner of Sugar. 3.

On receipt of such representation, the Respondent no.3 shall examine the same and shall take appropriate decision on it in

2 of 2 09.PB.WP.68.2017 accordance with law, after giving an opportunity of being heard to the Petitioners as well as Respondent no.4. Let the entire exercise be completed by Respondent no.3 within three months from the date of receipt of representation.
