for the reasons set out in the Civil Application, the delay in taking out the present application can be condoned, no doubt, subject to payment of costs. For the same reasons, the order dated 3rd October, 2018 dismissing the Petition for non prosecution can also be recalled, again, subject to payment of costs. 3.

Accordingly, Civil Application is made absolute in terms of prayer clauses (a), (b) and (c) subject to the Petitioner paying the Respondents cost of Rs. 6,000/- within a period of two weeks from today.

If the amount of cost are paid within two weeks, place the Writ Petition for admission on 21st January, 2019. In case there is any difficulty, the Petitioner is at liberty to deposit the amount of cost in this Court and thereafter the Respondents are at liberty to withdraw the amount at the rate of Rs. 1,000/- per Respondent. 5.

Civil Application is disposed of.
