Pursuant to the order dated 1st July, 2016 passed by this court, Shri Justice Pramod D.Kode, former Judge of this court has filed disclosure of statement in terms of section 11(8) read with section 12(1) of the Arbitration and Conciliation Act, 1996. The disclosure of statement is taken on record and is accepted. 2.

None appeared for the respondents though served. No affidavit in reply is filed.

A perusal of the correspondence annexed to the arbitration petition clearly indicates that there is no dispute that the arbitration agreement exists between the parties. The respondent however has disputed the claim on merits which can be decided by the learned arbitrator. Shri Justice Pramod D.Kode, former Judge of this court is appointed as a sole arbitrator. 4.

Arbitration Petition No. 7 of 2016 is disposed of in the aforesaid terms. No order as to costs.
